GoMediaWiki (the Website) provides skins, extensions, other products and services (the Services) in accordance with these Terms and conditions. The Services are designed to enable you to communicate with others. Unless stated otherwise the Services are for your personal and non-commercial use only. By using the Website/Services you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website/Services.

GoMediaWiki reserves the right to change or modify current Terms and Conditions with no prior notice. Your continued use of the Website/Services following any changes shall be deemed to be your acceptance of such change. It is therefore your responsibility to check the Terms and Conditions regularly for any changes.

Skin and Extension Licensing

Free Extensions

All our extensions are free and may be used and distributed by you according to the GNU general public license.

Skins

You are authorized to make any necessary modifications to our skins according to their respective licenses. All PHP portions of the free and commercial skins are licensed under the GNU/GPLv3 GPL version 3.0 license.

Free Skins

The non-compiled portions of our free skins including images and cascading style sheets (CSS) may be used and distributed by you according to the Common Public Attribution License Version 1.0. In short, we ask you to keep credit link to our website “as is” when you use our free skins.

Commercial Skins

The non-compiled portions of our commercial skins including images and cascading style sheets (CSS) are copyrighted and you may not redistribute them in any way.

Compatibility

When released our products are compatible with the latest version of target system. Whenever possible we try to implement support of older versions too.

Our skins support A-grade modern web browsers. It is impossible to provide identical experience for all these browsers because not all of the browsers support all of the web standards. However we will make our best to provide solutions in order to mitigate these shortcomings.

Ownership

Products

You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of GoMediaWiki. Our products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall GoMediaWiki be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.

Website and Services

GoMediaWiki and its content, including without limitation the Website design, text, graphics and all software and source codes connected with the Website (the Content), are protected by copyright, trade marks, patents and other intellectual property rights and laws. In accessing the Website you agree that you will access the contents solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.

GoMediaWiki does not claim ownership of any materials you post, upload or submit to any publicly accessible area of the Website. However, by doing so you are granting us a world-wide, royalty free, non-exclusive license to copy, distribute, transmit, reproduce, publicly display, edit, translate or publish such Content for as long as you elect to display such Content via the Website. The license shall be terminated when such Content is deleted from the Website.

Refund Policy

The Website offers non-tangible irrevocable, digital products that are based on intellectual property and therefore may not be returned. Thus the Website does not issue refunds.

Update and Support

All skins are always designed to be compatible with the latest available version of target system, but we can give no guarantee, that older skins will run with future versions. We are however committed to doing our best to make all the skins compatible with future releases.

Skin updates are available to customers who have made an individual skin purchase. They are also available for all the skins accessible by our club members whilst their club subscription is still active.

The Website offers these skins and designs ‘as is’, with no implied meaning that they will function exactly as you wish or with all 3rd party extensions. GoMediaWiki offers support for its products. For all free skins and products, the Website will provide support only in the public access forum for confirmed bugs. The public forum is designed to be a user to user forum. Subscription members are provided support through a private members-only forum, as well as an issue ticket system. The Website does not guarantee the speed of the provided support, but will work hard to address most issues within 24-48 hours (excluding holidays and weekends).

Termination and Price Changes

The Website reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, a subscription (or any part thereof) with or without notice for any reason, including without limitation, breach of these Terms and Conditions. The Website may also at any time, at our sole discretion, discontinue the whole GoMediaWiki or any part thereof without prior notice and you agree that we shall not be liable to you or any third party for any termination of your access to GoMediaWiki.

Prices of all subscriptions and products, including but not limited to monthly subscription plan fees, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Website.

Warranty

GoMediaWiki makes no warranty that the Website/Services will meet your requirements, that Content will be accurate or reliable, that the functionality of the Website/Services will be uninterrupted or error free, that defects will be corrected or that the Website/Services or the server that makes them available are free of viruses or anything else which may be harmful or destructive.

GoMediaWiki does not warranty or guarantee our products and services in any manner. We cannot guarantee they will function with all 3rd party components, plugins or web browsers.

Browser compatibility should be tested against the demonstration skins. Please ensure that the browsers you use will work with the skins as we can not guarantee that our skins will work with all browser combinations.

Security

You will be required to complete the registration process by providing certain information and registering a username and password for use with some Services. You are responsible for maintaining the confidentiality of the username and password and also for all activities which take place under your account. You agree to immediately notify us of any unauthorised use of your password or account or any other breach of security. In no event will the Website be liable for any indirect or consequential loss or damage whatsoever resulting from the disclosure of your username and/or password. You may not use another person's account at any time, without the express permission of the account holder.

Indemnity

You agree to indemnify and hold GoMediaWiki harmless from and against any breach by you of these Terms and Conditions and any claim or demand brought against GoMediaWiki by any third party arising out of your use of the Services and/or any Content submitted, posted or transmitted through the Services, including without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses) howsoever suffered or incurred by GoMediaWiki in consequence of your breach of these Terms and Conditions.

DISCLAIMERS AND LIMITATION OF LIABILITY

Use of the GoMediaWiki is at your own risk. The Website/Services are provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. To the extent permitted by law, GoMediaWiki will not be liable for any indirect or consequential loss or damage whatsoever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website/Services. Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of GoMediaWiki for death or personal injury as a result of the negligence of GoMediaWiki.

Severance

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
